Writing a will

In our opinion, everyone needs a will. Writing a will is the best way of ensuring that your estate (including your properties, businesses, savings, and all other assets) is protected and will be distributed in line with your final wishes if you should pass away.

We all know that it’s important to have a will in place, but getting around to writing one can be difficult if you aren’t sure of what to do. That’s where we can help at Wills Services, as we will help you write an accurate will online to provide you with peace of mind in knowing that your loved ones and assets are protected.

Why should I make a will online with Wills Services?

With our help, your will ensures that your estate is distributed without any substantial delay and in a way that suits your personal wishes.

This helps avoid any sort of family disputes regarding the estate and minimises the potential of financial and emotional distress that could otherwise be placed upon your family members, at a time when they should be left to grieve in peace.

You can rest easy in knowing that your loved ones will be provided for when you are no longer around and that your hard-earned estate will be inherited by the people that you choose.

Dying ‘intestate’ or without a will in place

If you die without a will, otherwise known as dying ‘intestate’, it could lead to lengthy legal proceedings and your assets may be inherited by the wrong people, or even handed over to the Crown.

Many people in the UK believe that their estate will automatically be handed over to their family if they were to pass away, but that isn’t always the case.

UK intestacy rules will determine how the assets you leave behind are distributed, and this may not always reflect your true wishes. Many factors can complicate the distribution of your estate via intestacy rules, including:

  • The value of your estate
  • Any children under 18
  • If you have children from previous relationships
  • If you have previous partners or you are not married
  • Same-sex partners without an official civil partnership

Who can write a will? Are there requirements for making a will online?

There are some requirements in terms of who is legally able to write a will, but we always recommend that you get in touch with us regardless of whether you think you’re eligible or not, and we’ll go from there.

We believe that every adult should write a will, but it is especially important for those with dependents, including any children and/or a spouse, as you need to ensure that they are provided for when you pass away.  You may have heard of bloodline wills and trusts which are a commonly used option to ensure that your direct family inherit your legacy as you wish.

Along with being over 18 years old, the other main requirement of writing a will in the UK is that you have ‘sound testamentary capacity’; this essentially means that you must have the mental capacity to understand what your will consists of and how your possessions will be distributed when you pass away. Because of this, it’s important that you create a will while you’re still of sound mind before it’s too late.

Note that active soldiers and sailors are exceptions and can make a will at any age due to obvious occupational hazards.

If you could be considered as being in a married couple, an unmarried couple, or have children, it’s crucial that you get in touch with us today to arrange a will.

Intestacy rules can become complex if you do not have a will in place, especially if you have step-children, children from a previous relationship, or if you are not married to your partner.

The UK’s intestacy rules do not recognise step-children or unmarried couples, so they will not be provided for automatically if you die without a will, reiterating once again the importance of having a professional will written to ensure that your estate is passed on in line with your desires.

When you have a will written with us at Wills Services, we will ensure that your assets are inherited by exactly the people that you intended and that your loved ones aren’t left in a difficult financial situation.

When should I write a will?

As long as you are over 18 and of sound mind, you can write a will whenever you feel it is necessary. This could be when you get married, have children, gain assets (businesses, vehicles, etc.), or buy your first home.

We know that writing a will is highly unlikely to be the first thing on the mind of an 18-year-old, but the sooner the will is written, the less chance there is of your assets being passed on to the wrong people or the Crown.

Our online service also means that you can start your will anywhere from any device.
